Arbitration
Submits disputes to a named arbitral forum before any court is approached, with the provider, the venue and the binding effect all stated as terms rather than assumed.
- Clause id:
arbitration@1.0.0
- Activated by the
arbitration module
- Composes after:
## Article III - Powers (a document package may override this through its anchors map)
- Placeholders:
arbitrationProvider, arbitrationVenue, bindingEffect, feeAllocation
Item numbers in this clause are canonical: they open at 1.1 under the
clause's own heading and never assume a host document's numbering. A
consumer composing the clause renumbers it to continue the target
document.
Source: Entity.ID drafting. The Accord Project template library carries no arbitration clause, and the source formation set carries none either; the structure follows the dispute article the Entity.ID formation app renders today for Kleros, with the provider, venue, binding effect and fee allocation lifted out as terms
Licence: Apache-2.0
Legal review: New drafting. The app's current article hard-codes one provider, its court, its non-binding effect and its fee subsidy; those are data about one forum, not law, so they are variables here. 1.6 makes the clause depend on governing-law rather than standing alone.

Arbitration
1.1 Any dispute arising out of or in connection with the formation, operation, interpretation, performance or termination of this Constitution, including a question of its validity or breach, shall be submitted to Kleros, a decentralized dispute resolution forum.
1.2 The dispute shall be resolved in the General Court, in accordance with the dispute policy of that forum in force at the time of the dispute, which governs the criteria for resolution, the number of deciders and the timelines.
1.3 The forum shall receive the claims, responses and evidence of the parties, present the question for decision, and notify the parties of the outcome.
1.4 The resolution is non-binding, and advisory to the parties. The parties shall consider the outcome in good faith as a means of resolving the dispute between themselves.
1.5 The costs of the forum are borne equally by the parties, except where the forum subsidises them.
1.6 Where the parties do not resolve the dispute under this clause, the dispute is resolved under the law and in the forum stated in the governing-law clause of this Constitution.
